    He is a liar. He intended to either slow down the car or see how close he could get to the car’s bumper and then speed off. That “trick” is popular in these video-biking groups and he miscalculated his speed and got bumped. I believe he is responsible for everything that happened after his maneuver and he and others who participated should have all the books thrown at them! There is enough danger on the road without these fools making deliberate choices to drive recklessly and cause harm to others.

      Let’s not forget that cars are always more of a danger to motorcyclists than motorcyclists are to cars.You say “That ‘trick’ is popular in these video-biking groups” well as a rider myself I can tell you I’ve never seen anyone ever do anything like that on purpose. So it would be nice for you to back up such a statement with said videos. As riders we have to ride as if cars are always going to kill us because it can happen that easily. We can’t slow down as fast as a car and I believe Mr. Cruz’s statement. Also the driver of the SUV was traveling much to close even before Cruz looked back for his friends in the group. He was tailgating Mr Cruz he should have decreased his speed and let the riders go past him put his blinker on and moved over a lane.

        I would say “Nice try” but damn. If this is all you have for a defense they as good as convicted. Nothing they were doing was legal or correct riding. NOTHING.

        Agree cars are more dangerous than motorcycles and that there are some good, careful bikers on the roads. But there are enough biking groups that do the kinds of asinine things that Cruz did. He was not simply changing lanes as he claims; notice that he was sharing the lane with the SUV when he approached the front of the car and then moved further into its path while slowing down in front of it. The SUV didn’t change speed; no car driver in their right mind wants to hit and potentially kill someone on a motorcycle. But having lived in the DC area for over 20 years, I have seen antics like this on the road and experienced reckless bikers quite frequently (especially on those crotch rockets). The SUV driver was under no obligation to more over (nor could he since there were bikers on the other side as well that he might have hit in a lane change—a move that would have been deemed clearly his fault). He did what most of us do—keep the same speed and wait for the bikers to clear a path so we can safely maneuver our much larger cars. My driving mantra has always been yield to the larger vehicle—-too bad Cruz doesn’t do the same.

          The video is CRYSTAL clear. Ironic that it came from a member of the group who wanted to record their “tricks” on the road after they shut it down. The entire video is an indictment on improper motorcycle use. There really is no argument here to the contrary. Don’t forget. NO VALID LICENSES for Mieses nor Cruz and Mieses had just been arrested for not having one in May. Daddy of the year I think not.

        How was he tailgating when Cruz pulled in front of him and slowed down? Maybe you aren’t familiar with these dirt bike groups in NYC, but I can tell you firsthand they are very dangerous, disrespectful and annoying. The tape clearly shows how these guys were behaving before anything happened. And if you need further proof of their antics, someone posted like 7 of their videos from Hollywood Stuntz that of course they tried to pull down when all of this stuff hit the fan. Cruz seems like a dumb kid who is trying to pout and mumble his way out of the consequences for his idiotic behavior. He will find that the prosecutor and judge aren’t the enablers that his mother obviously was.

        The fact of the matter is these motorcyclists were trying to intimidate this suv. True enough cars are more of a danger, but some motorcyclists don’t all share the same mindset as many others. Ive seen them deliberately cut off drivers forcing the car to make a quick decision to slow down, putting cars in danger as well. My dad owns a bike, my brother in law owns a bike, I have friends who own bikes, but its not about what goes on around the world. Its about what happened in this moment and if Cruz was simply changing lanes, why was he so close to the SUV, you are saying the SUV increase his speed to intentionally cause an accident? come on. I know it first instinct for you guys to stick together but that was pure ignorance on his part. Ive seen biker increase their speed with they change lanes no decrease it on an open road with no traffic in the front of them, so why would he slow down? Looking for his other bikers? they were all around he wasn’t miles ahead of them. He has no case if that’s his defense. And with 40 bikers all around you how can you decrease speed, if a biker was behind him then he would have went into the back of the suv. Everyone was wrong in this video, but if I have my wife and kid in a car im making sure I get them to safety.
