US Airman Stands His Ground In Florida, Sentenced To 25 Years

Former U.S. airman, Michael Giles,  is currently sitting in a Florida prison for what his supporters argue was a simple act of self-defense.

Just two years into a 25-year sentence, he joins a list of cases that have drawn national attention to the Sunshine State’s sentencing and gun laws. Encouraged by the activity, his family is hoping to stir up interest in his case and is currently petitioning Florida’s governor for clemency.

According to court documents, an argument quickly escalated into a brawl involving 30 to 40 young men.

Giles reportedly was not involved in the melee but, separated from his friends, went outside to the car where he had a gun, for which he had a concealed carry permit. Giles put the weapon in his pants pocket and searched the crowd for his friends. Suddenly, he says, someone from the crowd punched him. Knocked to the ground and in fear for his life, Giles says he pulled out the gun and fired one shot into the leg of his alleged attacker.

          Yeah, it is about race. While Gracie needs to work on her writing skills, you are a complete fucking moron cloaked in privilege to suggest that race isn’t a factor. Zimmerman killed some kid with Skittles who was visiting his dad and was acquitted. A ceiling and a man’s leg were injured and both cases involving blacks resulted in sentences a quarter of a century in duration. Oh, and by the by:

            Seriously you should not open your mouth without the facts. The thug that attacked Zimmerman had just bought skittles and Arizona iced tea (those are 2 ingredients used to make the drug sizzurp or lean). He was a known trouble maker, liked to fight and make people bleed. Zimmerman was getting his head smashed into the concrete, he had every right to defend himself. The kid in this story went to his car, got a gun, went back to a brawl, gets punched in the face and thinks he can shoot someone. If the attacker had him on the ground punching him senseless that would be a different story. You can’t shoot someone because they punch you in the face. GET REAL!!!!!!

          Correction Tony, Zimmerman is actual 3/4 white and 1/4 Amerindian being that his mother is from Peru and is of mixed heritage of that being European and Amerindian thus Zimmerman would be classified here as being of the White race but Hispanic descent, sorry dear but your wrong.

          He’s white. Hispanic is a nationality, not a race. You can be black, white or Asian and still be Hispanic.Unfortunately, Tony, most people’s views on a high profile case hinges on the race of those involved. Especially if the races of the alleged criminal and victim are different.

      This means nothing in a state that says you have the right to protect yourself with a gun if you believe to be in danger. If were in another state I would say you are right. But this is Florida we are talking about. Please read what the Stand Your Ground law means.

    I’d frickin shoot that person too! It was in the leg, not his chest or head. He was obviously scared, and was trying to protect himself, and used non-lethal shots. Let him go.

      He missed. No one, especially the armed forces, are taught and trained to “hit in the leg”. It was a stressful situation, he probably jerked the trigger, and impacted low.

          Assume all you want. Have you been through a standard Military firearms instruction course? Practiced aiming and firing in stressful conditions? Aware of what various mistakes in trigger pull do to the impact point of a round? My guess is no to all.

      Mmm, he was hit when he got back in though. While I understand exactly what you’re saying, and I don’t necessarily agree or disagree, I think this poses an interesting question. He did leave the danger and went back, but there is something to be said for having come back in to see about his friends. You can in fact fight or whatever in defense of others, and that may be what he was going to do. He wasn’t hit BEFORE he got the gun. So I would argue that the danger that is applicable to the SYG was the hit that came after he got the gun, not the initial melee.

      Obviously U can’t read very well!!! It said he went to go an locate his friends, not that he went back to commit a crime, duh. And it also said that he had a RIGHT to carry the gun by permit so what crime exactly did he commit? Protecting himself from someone who attacked him?

    Florida’s Stand Your Ground law is written in a way that allows Florida to circumvent the 4th Amendment by encouraging people to confess to the police on the hope that the police will believe them, rather than encouraging these same people to keep quiet and wait to see what information the police turn up on them without a confession.       If I remember correctly, no one died. He just wounded the guy by shooting him in the leg. But yes, it was a white man, IIRC

      He did not kill anyone. He shot at the man who punched him. And he shot him in the leg and that was it.

      Also the man who attacked him admitted to being in the wrong.

    If you read the article it states that he went to the car to get the gun, then reentered the area where the melee was taking place. This is where his problem lies…had he had the gun on him already then he would not have been charged or convicted. This is where the prosecution can argue premeditation, looking for trouble, etc. He committed a crime by reentering the situation after arming himself. They can also argue that he had the opportunity to call the police for assistance if he had the chance to go get the gun. This is not a stand your ground situation…my opinion may not be popular, but if you look at it objectively, I’m not wrong.
